By accessing or using Aboutime or any other services provided by TriCore Innovations ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not access or use our services. We reserve the right to modify these Terms at any time, and your continued use of our services constitutes acceptance of any changes.

2. Description of Services

TriCore Innovations provides Aboutime, a workforce management software platform that includes:

• Time Tracking: Employee clock-in/clock-out functionality with optional GPS verification and geofencing.
• Schedule Management: Tools for creating, managing, and distributing employee schedules.
• Reporting: Analytics and reports on employee attendance, hours worked, overtime, and labor costs.
• Employee Management: Features for managing employee profiles, roles, and permissions.
• Mobile Applications: iOS and Android applications for employees and managers.

We may modify, suspend, or discontinue any aspect of our services at any time, with or without notice.

3. Account Registration and Security

To use Aboutime, you must create an account and provide accurate, complete information. You agree to:

• Maintain the confidentiality of your account credentials
• Immediately notify us of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account
• Ensure that all users added to your organization's account comply with these Terms
• Not share your account credentials with unauthorized parties

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

4. Acceptable Use Policy

You agree not to use Aboutime to:

• Violate any applicable laws, regulations, or third-party rights
• Upload or transmit viruses, malware, or other malicious code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the integrity or performance of our services
• Collect or harvest user information without authorization
• Use our services for fraudulent timekeeping or misrepresentation of work hours
• Reverse engineer, decompile, or attempt to extract the source code of our software
• Use automated systems or bots to access our services without our written permission

5. Subscription and Payment Terms

Subscription Plans: Aboutime is offered on a subscription basis with various plans based on features and number of users. Current pricing is available on our website or upon request.

Billing: Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan. All payments are processed securely through Stripe.

Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.

Price Changes: We may change our prices upon 30 days' notice. Price changes will take effect at the start of your next billing period.

Taxes: Prices do not include applicable taxes. You are responsible for paying all taxes associated with your subscription.

Refunds: Refund requests are evaluated on a case-by-case basis. Contact our support team within 30 days of payment to request a refund.

6. Data Ownership and Responsibilities

Your Data: You retain ownership of all data you input into Aboutime, including employee information, time records, and schedules ("Customer Data").

License to Us: You grant us a limited license to use, process, and store Customer Data solely to provide our services to you.

Data Accuracy: You are responsible for the accuracy and legality of Customer Data. You must ensure you have proper authorization to input employee information into our system.

Data Export: You may export your data at any time through our platform. Upon account termination, we will provide a reasonable period for you to export your data.

Compliance: You are responsible for ensuring your use of Aboutime complies with applicable labor laws, data protection regulations, and employment requirements in your jurisdiction.

7. Intellectual Property

All intellectual property rights in Aboutime, including software, designs, logos, trademarks, and documentation, are owned by TriCore Innovations or our licensors. These Terms do not grant you any rights to use our trademarks or branding without prior written consent.

You may not copy, modify, distribute, sell, or lease any part of our services or software, nor may you reverse engineer or attempt to extract the source code.

8. Service Availability and Support

Availability: We strive to maintain high availability of our services but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible.

Support: Technical support is available via email at tricoreinnovations@gmail.com. Response times may vary based on your subscription plan and the nature of your inquiry.

Updates: We may release updates, patches, or new versions of Aboutime. Some updates may be required to continue using our services.

9. Disclaimer of Warranties

ABOUTTIME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our services will be uninterrupted, error-free, or secure. We do not guarantee the accuracy of any data or calculations generated by our services. You are responsible for verifying the accuracy of time tracking and payroll data.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRICORE INNOVATIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF ABOUTTIME.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless TriCore Innovations and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of Aboutime, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

By You: You may cancel your subscription at any time through your account settings or by contacting support. Cancellation will take effect at the end of your current billing period.

By Us: We may suspend or terminate your access to Aboutime immediately if you violate these Terms, fail to pay fees, or for any other reason at our discretion.

Effect of Termination: Upon termination, your right to use Aboutime ceases immediately. We may delete your data after a reasonable retention period, unless otherwise required by law.

13. Governing Law and Disputes

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless you are entitled to bring claims in small claims court.

YOU AGREE TO WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

14. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and TriCore Innovations regarding Aboutime.
• Severability: If any provision of these Terms is found invalid, the remaining provisions will continue in effect.
• Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
• Assignment: You may not assign these Terms without our prior written consent. We may assign our rights and obligations without restriction.
